New EPA Lead Renovation, Repair and Painting Rule

The federal government wants to “Get the Lead Out”.  A new Environmental Protection Agency rule took effect on April 22, 2010. This new rule affects all homes built prior to 1978. The new ruling went into effect due to health risks associated with lead based paint that can affect children’s brains and their developing nervous systems, adult health and pregnant women.

The new regulation comes into effect when you begin common renovation activities like sanding, cutting and demolition which create lead dust and chips when the lead-based paint is disturbed. The rule requires the use of lead-safe practices and other actions aimed at preventing lead poisoning. Contractors performing renovation, repair and painting projects that disturb lead-based paint in homes built prior to 1978 must be certified and follow specific work practices to prevent lead contamination. A certified contractor must be used when work disturbing the lead-based paint is more than six square feet on the interior and more than 20 square feet on the exterior.

If we have to make a repair to your property that involves the new EPA rule, the cost of such repairs will increase due to the increased cost of following the new procedures and through having to use a lead-based paint certified contractor. Our maintenance division has gone through the certification process to ensure compliance with the new rule.

We are currently working on a relationship with a testing facility to provide lead based paint testing services.  If you would like to have your property tested upfront for the presence of lead-based paint, it may help to reduce the expense of having to use a certified contractor if it can be determined that lead-based paint is not present in your property. We will send you additional information on this as it materializes.

What is a Short Sale?

A short sale is a transaction in which the lender, or lenders, agree to accept less than the mortgage amount owed by the current homeowner. In some cases, the difference is forgiven by the lender, and in others the homeowner must make arrangements with the lender to settle the remainder of the debt.

Why is the number of Short Sales rising?

Due to the recent economic crisis, including rising unemployment and declines in home prices in communities across the nation, the number of short sales is increasing. Since a short sale generally costs the lender less than a foreclosure, it can be a viable way for a lender to minimize its losses.

A short sale can also be the best option for homeowners who are “upside down” on mortgages because a short sale may not hurt their credit history as much as a foreclosure. As a result, homeowners may qualify for another mortgage sooner once they get back on their feet financially.
